Junior, brown Morgan/Arabian Cross Gelding Lost - Waterbury, VT--
Washington County, September 28, 2008

Waterbury, Vermont - Stolen Horse International, aka NetPosse.com,
and The Vermont Horse Council hope you can help them track down a 13-
year-old girl's lost horse in the Waterbury-Middlesex area.


Junior went missing from his paddock in the Perry Hill area of
Waterbury Monday night September 28, 2008. His owners believe he was
spooked by something-- possibly a moose-- which took down his fence.
He has not been seen since.

Riders have been looking for the Morgan-Arabian cross on horseback.
They found some tracks-- but not Junior, so they're hoping more
volunteers will join their search.

Where in Vermont is Junior? He may be lost in the woods, hurt or
worse. He could be with a good Samaritan who does not know where he
belongs. On the more sinister side, he could have been picked up by
someone hoping to make money off of their new found horse. All of
these scenarios are possibilities we have encountered with lost
horses at NetPosse.com.

Junior is a 25 year old brown gelding. His owners say he may respond
to Junior or Junebug.

A Friesian Mare missing from farm in Mukwonago , WI is on the way
home thanks to NetPosse.com's IDAHO Alerts for missing horses. Patti
and Alobje are on their way home as this update is being posted!

We cannot give out all of the details at this time but we can tell
you that after our IDAHO Alert was sent out earlier this month a tip
was received concerning the location of the two horses. Patti left
immediately and has spent the last week in Wisconsin.

While there she was befriended by local horse owners who had also
received the alert and were ready to offer Patti support. After two
appearances in court and a roller coaster week, Patti called today
ecstatic that her ordeal is over.

She has said a special thank you to NetPosse in a phone conversation
today and she would like everyone to know that without our help this
moment would not have been possible. She would like to thank all of
the people who have come forth to help her this past week, as well as
those who have posted information across the country.

We hope to have the rest of the story after Patti and Alobje arrive

How Stolen: Persons or person parked a trailer in the driveway and
went into the barn behind the house took halters and walked the
horses to the street through the yard next to the house and loaded
the horses in a trailer. The main gate was locked and the primary
resident was out of town.

Sister, from Elk Creek Camp in Garden/Custer County, ID - Oct. 16,
2008
How missing: Mare got loose while tied at hunting camp. Went back to
trailhead and trailer. Wandered around until next day when 4-wheeler
tracks in the snow show she was chased and then caught by the rider,
led to a trailer and hauled away. Was the mare stolen or does a
good "Samaritan" have the horse?

• Funding to Cover Horses Care During Appeal and/or Facility to
Provide Lifelong Home

• Are there any Rescues willing to Take Two Horses and Provide
a Guarantee of a Lifelong Home safe from abuse, neglect, and
slaughter?

• If not why not? We need to provide the Court with reasons why
Rescues are not able to take these horses...The Court needs to
understand the state of Horse Rescue.


Sadly in this world most people only value a horse if it can perform
or produce, cats and dogs are not required to perform to have a home,
nor are exotics, why is our beloved horse excluded from the club?

In an ideal world these horses would have a home with a little girl
who all day dreamed of nothing but getting home from school so she
could run outside and spend time with her beloved horse- fussing over
him, grooming, putting braids in for the fun of it, and feeding him
carrots and apples, reading them stories, cherishing every moment she
had with her horse.

With the economy the way it is, it is doubtful there is anyone
willing to provide the EPN with the funding to care for these horses,
let alone a lifelong home for either of these horses. If anyone is
willing and able to do so, please contact the EPN, send us an e-mail,
leave a message at 570-345-6440, and then follow-up in writing with
the documents proving your ability to do so and we will pass them on
to the Court. The Court must have proof that those offering to care
for these horses have the means to do care for these horses.


BACKGROUND

Two horses, both geldings and both lame, one in need of shoulder
surgery to repair an injury from a T-Post 5 Years ago, are the
subjects of a cruelty case where the owners have been found guilty
and fined the maximum fines on all four counts, $1500.00 each. The
Court has offered them a reduction in their fines IF they voluntarily
surrender the horses and waive their appeal.

In court testimony it was demonstrated that the owners are repeat
offenders, do not have the funding to properly care and feed for the
horses, have failed to follow the instructions of their vet, ( who
testified against them) and do not have adequate shelter.

The owners' animals live in a flood plain with trees denuded of their
bark, amongst trash and junk with a wooden structure filled with
manure, junk. Huge sections of the "walls" and "roof" are missing and
the structure does not provide shelter that keeps the horses dry and
allow them to maintain their body heat. One horse is tied to an air
compressor with a heavy iron tow chain. The other runs free only a
few hundred yards from a busy road. In the past, a horse in their
care was killed on this same road.

The horse with the shoulder injury has a suppressed immune system, a
wound draining pus and blood that you can palpate 8 inches, and is
covered in buzzing flies feeding on the drainage covering his
shoulder and draining down his leg and onto his chest. His body
condition is fine. Last year he was starving; the owners were
arrested and his condition improved by the time the case went to
court. Currently his body condition is fine because he eats the other
horse's food. Therefore, we know he is not being fed the proper
amount...

The 2nd horse, 13 years old, is lame, his stifle and ankle are not
normal, he has an old injury and a scar that has damaged the coronary
band and according to the vet he needs x-rays to diagnose the
problem. When ridden he lies down after a few steps. Earlier this
year, he was a two on the Henneke Body Condition Scoring Chart. Last
year he was a two until the owner was arrested and went to court.
Years ago the EPN assisted law enforcement on a call for no shelter
on this same horse. The horse was relocated and the issue was
resolved.

The owner has him because they love him and they have had him since
he was a year old. The owner believes it is fine for a horse that
does nothing to have all his bones exposed and the shelter is
acceptable.

It is interesting that the Russian government during the Siege of
Leningrad in 1941-1944 was well fed and warm while the inhabitants
froze and starved to death. The owner of this horse has not missed
any meals, even though they could stand to miss several.

This Can Go Two Ways:

1. The owners appeal their conviction. If that happens the Court
will order the horses forfeited. The horses will then be held as
evidence until the appeal is heard. It could be a year or more until
the appeal is heard. Funds are needed to cover the cost of their care.

2. The owners agree to forfeit the horses.

So what do we need?

If Owners Appeal

The EPN needs the funding to cover the cost of care and cost of
repairing the shoulder during the time the horses are held as
evidence. The horse will need to be transported to a university vet
hospital for evaluation and recommended treatment for the shoulder.
The EPN has assisted law enforcement during their investigation and
successful prosecution. It is vital for the case that the horses, the
evidence, be maintained properly or the case could be lost at the
appeal level on a technicality.

The cost of surgery is estimated to be several thousand dollars. A
ballpark estimate to care for these two horses including feed,
shelter, veterinary, farrier, and dentistry care during an appeal
lasting a year is $15,000.

If the EPN has to hold these horses as evidence we must have the
shoulder repaired, estimated to be several thousand dollars. A
defense attorney would have a field day if we did not. The excuse of
a lack of finances is the same defense the owners' are using, so the
defense would have a built in defense if the shoulder were not
repaired.

The other lame horse needs x-rays. He lies down after a few steps
when ridden. These horses are evidence in a crime and must be
maintained as such If they are not, the defense can have the evidence
thrown out with the case being dismissed or the owners acquitted and
the horses being returned to the owners to live in a swamp with no
shelter, no vet care, and not enough food to slowly starve to death.

What must be understood is that the Appellate Court with jurisdiction
has reputation for giving people 2nd chances, so there is the very
real possibility that after an organization has paid for the surgery,
x-rays, and all the other horse related care during the year the case
is on appeal, the horses will be returned to the owners, even if the
owners' guilty conviction is upheld!!...no money will be paid to the
EPN or any other welfare organization for the money they expended to
care for the horses.

If the Owners Surrender the Horses We Need:

A Rescue that can provide a guarantee of a lifelong home safe from
abuse, neglect, and slaughter.

The EPN has assisted law enforcement in the investigation and
prosecution of this case and is now assisting the court in locating a
rescue that has the funding and facility to care for these two
horses. Only non-profits qualify, although if you are an individual
and are willing to care for these horses for a lifetime, you can
qualify to provide these horses through a non-profit. If a home is
guaranteed, a non-profit is more likely to take on these horses.

Any Rescues that are Unable to Take these Horses - please submit
reasons why not - full, lack of funding, etc. We need the reasons as
to why rescues are not able to take these horses so the Court has an
accurate picture of the status of rescues available to take horses in
a cruelty case.

It is the EPN's opinion that the owners of these horses, not a
rescue, should be the ones to put their horses down. Responsible
owners make the decision to put their horses down when they cannot
afford surgery or to care for a horse that has no value in the horse
industry except as meat. It is not the responsibility of rescues to
make the decision to put down owners' horses and it is about time
that owners be held accountable for their actions. One reason Animal
welfare caregivers burn out is due to the high cost of humane
euthanasia, forced to kill animals because there are not enough
resources to care for them.

It is time that irresponsible owners make these decisions for their
own animals, not a handful of caring animal people forced to make and
carry out the decision to take hundreds of animals' lives in the name
of welfare.

It is our opinion, and other rescues we have consulted with, that the
owners should be the ones ordered to euthanize these horses, not a
rescue. There is no market for these horses and responsible owners in
the same position would be forced to make the unpleasant choice to
put down their horse because they did not have the funds to perform a
necessary surgery, or because no one wants their lame horse. Why
should these owners, guilty of neglect, be rewarded? Why should the
Public pay to fix their horses while responsible owners are forced to
put their horses down when they cannot afford surgery?

Yes we understand it is the horses that pay the ultimate price, but
responsible owners' horses pay that price too. It is time that
neglectful owners start paying part of the high price of horse
ownership.

In an ideal world these horses would have a home with a little girl
who all day dreamed of nothing but getting home from school so she
could run outside and spend time with her beloved horse- fussing over
him, grooming, putting braids in for the fun of it, and feeding him
carrots and apples, reading them stories, cherishing every moment she
had with her horse.

Sadly in this world most people only value a horse if it can perform
or produce. With the economy the way it is, it is doubtful there is
anyone willing to provide the EPN with the funding to care for these
horses, let alone a lifelong home for either of these horses. If
anyone is willing and able to do so, please contact the EPN, send us
an e-mail, leave a message at 570-345-6440, and then follow-up in
writing with the documents proving your ability to do so and we will
pass them on to the Court. The Court must have proof that those
offering to care for these horses have the means to do care for these
horses.

The EPN Benefit Auction is scheduled to begin on Ebay December 8th,
2008.Unfortunately the company we hired to hold the auction for us,
AuctionInn, backed out on us at the last minute.

The EPN hired AuctionInn, a company that proclaims to help non-
profits hold benefit auctions, due to the fact that I do not have the
time to run the auction and the EPN does not have a facility where
volunteers could prepare the items for Ebay. If you had asked me if a
company could walk away from their agreement with a charity during
the holiday season and nobody would care, I would not have believed
it.

Well, I believe it now. All of our pleas to media outlets to cover
this story in an attempt to locate another company that would help us
run the auction, an auction whose proceeds would help cover the cost
of feeding and caring for a former public servant went unheeded.

The EPN was counting on the money raised going to feed and care for
Randy, the former therapeutic ridiing horse in our Sanctuary Program.

Hopefully we can find a company or individual who is willing to
donate their time and resources to run the EPN Benefit Auction. The
EPN volunteers have been blessed with really wonderful items donated
by generous donors who believe in and support our efforts to Save
America's Horses through owner accountability and responsibility.

My name is Christine Berry and I am the founder of the Equine
Protection Network, an organization who has focused on the transport
of horses in double deck trailers since 1995. I am asking for your
help, the same help that you provided us that resulted in the passage
of the PA Horse Transport Law of 2001, the strongest law in the U.S.
banning doubles to transport any horse, no matter what its final
destination.


IL Rep Mark Kirk introduced HR 305 intended to ban the use of double
deck trailers to transport any horse no matter what its final
destination. The language is modeled after the PA Horse Transport
Law, the strongest law of its kind in the US and successfully
enforced. The problem with the bill, and why we are opposing, is
CIVIL the penalties which makes the law impossible to enforce.

HR 305 has civil penalties which means that the police CANNOT enforce
any violations!

Until Rep Kirk amends HR 305, changing the penalties from civil to
criminal, we MUST OPPOSE.

Without criminal penalties, passage of this legislation is nothing
more than a publicity victory. I have provided Rep Kirk's office with
the justification and proof that without criminal penalties the law
will not achieve the goal of banning doubles because it is
unenforceable. The reason provided to me for the civil penalties was
that it would be easier to pass.

For several years, I provided the New York State and PA State Police
with information on the location of double deck trailers transporting
horses in violation of the law. I know what it takes for law
enforcement to make an arrest and for the prosecution to win in
court. As one who has observed these laws being violated and has
worked to have the violators stopped, arrested and successfully
prosecuted week in and week out for several years, I know what it
takes to have a double carrying horses stopped, offenders arrested,
and successfully prosecuted. The State Troopers and Assistant
District Attorneys who have enforced the New York and Pennsylvania
laws banning double deckers agree that without criminal penalties,
there will be NO enforcement.

Here are the problems with civil penalties & the solution:


• Public cannot call 911 to report a violation upon observing a
double decker with horses on board.
o How will the U.S. Attorney General know how many violations
unless the trailer is stopped by law enforcement so the number of
horses can be counted and documented for court?
o Is the Public expected to investigate, collect, document, and
then provide the evidence of the violation to the U.S. Attorney
General's Office?
o Unless a trailer is stopped, it is impossible to document the
number of horses on the trailer.
o Private citizens often observe these trailers while traveling
the opposite direction on a limited access highway making it
impossible for them to observe or obtain a license plate or any other
identifying information. Without this information, how can the U.S.
Attorney General's Office know who to arrest?
o Past experience has demonstrated that even with a description
of the truck, law enforcement has been unable to locate a truck
reported to be transporting horses in a double deck trailer.
o Private citizens have reported violations of the Commercial
Transportation of Horses to Slaughter Act of 1996 only to be told by
APHIS that APHIS does not accept reports of violations from the
public!
• State and local law enforcement cannot enforce a law with
civil penalties, only criminal penalties
• State and local law enforcement have no incentive to contact
the federal government on a law with civil penalties and no related
state or local law.
• The federal law enforcement agencies do not respond now to
calls from state law enforcement agencies regarding motor vehicles
stopped with illegal aliens. If the feds will not respond for a van
full of human cargo, why would they respond for a truck loaded with
horse cargo?
• Enforcement will only happen when:
o there is an accident because law enforcement will investigate
the accident, thus collecting the evidence needed to prosecute.
o In states where there is a law banning doubles, PA, NY, MA,
MD, RI, VT, state and local law enforcement can enforce the state
law, and the U.S. Attorney General could file federal charges because
the evidence will be collected by law enforcement.
o At the U.S. border, if the U.S. border patrol, USDA, and U.S.
Customs officials are aware of the law. Again, the Commercial
Transportation of Horses to Slaughter Regulations demonstrates that
this does not happen. U.S. D.O.T and Motor Carrier inspectors are not
aware of the law and do not report suspected violations to APHIS.
• The failed enforcement of the federal regulations, which has
Civil Penalties, compared to the successful enforcement of the NY and
PA state laws with criminal penalties proves that Civil Penalties are
not effective.
• State legislators will point to a federal law banning doubles
as a reason not to pass state legislation. As pointed out above, in
states where there is a law in place, is where the federal law could
be enforced.

The SOLUTION

Amend the law to a chapter in Title 49 Transportation that has
criminal penalties. Title 49 Chapter III Part 393 provides criminal
penalties and would allow law enforcement state law enforcement
officers who have been trained and authorized to enforce the federal
motor carrier safety program laws.

Kirk's office maintains that the high fines will be a deterrent.
Facts prove that the death penalty does not act as a deterrent. Facts
prove that Arlow Kiehl and Don Nickerson, Nickerson Livestock, were
not deterred by Carper's conviction and $11,000 fine in NY, or Three
Hills Rodeo was not deterred by New Holland and Sugarcreek
Livestocks' convictions.

The EPN opposed the PA Horse Transport Law for 5 years because if
passed, it would have been nothing more than a publicity victory. We
stood our ground despite criticism and the result was the strongest
law in the country; One of PA's strongest criminal laws praised by
police and prosecutors alike, and successfully enforced and
prosecuted.

  I urge you to please contact Rep Kirk's office requesting that HR
305 be amended with criminal penalties as recommended above.

If you have any doubts regarding what I am telling you, contact law
enforcement agencies tasked with patrolling the interstates and ask
them if HR 305 will be enforced with civil penalties. Contact the
U.S. Attorney General's Office and ask them what evidence they would
need to file charges and what they would need to successfully
prosecute a case.

Please alert your supporters and other animal welfare advocates
asking them to withdraw their support until HR 305 is amended with
criminal penalties.

Something is not better than nothing…

Owners Conviction for Cruelty Upheld in Court of Common Pleas.

Pottsville, PA –On January 27, 2009 in the Schuylkill County Court of
Common Pleas, Judge William Stine in a trial de nova, found Ernest
Schaeffer, Pine Grove, at one time an elected constable for
Washington Township, and his daughter, Pamela Heiser, Schuylkill
Haven, a school bus driver guilty of one count each of cruelty to
animals, Title 18, 5511 (c). Heiser and Schaeffer each have to pay
$500.00 plus court costs. The horses, Pretty Boy, a lame 14 year old
chestnut paint gelding, and Blackjack, a black quarter horse type
gelding, remain in the custody of the convicted animal abusers.
Pretty Boy's whereabouts are unknown and BlackJack remains at the
original location.

Blackjack's right shoulder has an infected and draining wound.
According to Schaeffer the wound was caused by a T-Post 6 years ago.
The wound is an eight-inch channel into his shoulder. Flies
constantly swarm around the wound feeding on the drainage. No
measures recommended by the vet have been undertaken by the
defendants to improve the condition, except Penicillin injected at
less than adequate amounts and intervals by Schaeffer who testified
in court that he is not home much anymore. A course of Sulfa drugs
was administered last summer at the urging of the vet during the
criminal investigation. The owners were advised that surgery is
required to clean out the channel and remove any foreign bodies that
are preventing the wound from healing. Due to the cost, estimated to
be in the thousands, the owners took no action. The owners were
advised to shave the hair and apply Vaseline to protect the skin from
burning due to the drainage and fly control methods were suggested,
none of which have been undertaken according to the vet who has
examined the horse or investigators.

The defendants' own vet testified for the prosecution and in regards
to Pretty Boy's condition stated,

"(Horses) need to eat probably 1 to 2 percent of their body weight
per day, …it's pretty unlikely he was getting that." In regards to
both horses he stated," neither was in good shape,"  and "I
believe ... both horses could be considered neglected. I think it
likely" both were deprived of sustenance"

The defendants' attorney, James G. Conville, Schuylkill Haven, asked
for an acquittal, saying prosecutors had not proven their case.

Conville argued, "There were issues with these horses and they took
adequate measures," he said of his clients. "Is this a thoroughbred
stable? No, it's a farm structure."

Assistant District Attorney Doug Tagliere responded to that argument
by stating that Pretty Boy and Blackjack deserved better than what
they had.

"These animals lived amongst garbage," he said. "The statute protects
every horse."

The defendant Heiser testified in her own defense, defiantly reading
off receipts for feed purchased along with one wormer over a several
month period. Assistant District Attorney Doug Taglieri pointed out
that the receipts only proved Heiser had purchased the feed, not that
she had fed the feed to the horses in question or that the feed was
fed in adequate amounts to maintain the horse in acceptable body
condition.

At the time of sentencing Court of Common Pleas Judge D. Michael
Stine stated,
"There still was a conscious indifference" to the condition of
Blackjack and Pretty Boy"

The EPN applauds the PA State Police, the District Attorney's Office,
and the Courts for their investigation, prosecution and conviction of
the owners of these horses who were given numerous chances to correct
the situation, but who chose instead to defy the law.

Schaeffer and Heiser were first convicted on October 14, 2008 by
Judge Carol Pancake in Tremont District Court on 2 counts each of
cruelty to animals, Title 18, 5511(c) and fined the maximum fine,
$750.00 on each count, appealed their convictions to the Schuylkill
County Court of Common Pleas in Pottsville. Judge Stine dismissed the
2nd count of cruelty against each defendant stating that only one
charge of cruelty to animals under the same section can be filed
against a defendant on the same day. Two counts were filed due to the
defendants' failure to provide food, water, and shelter, all of which
fall under the same sub-section.

Background

The PA State Police filed the charges in August after first
responding to a complaint of a starving horse in June. Upon
investigation a chestnut paint gelding approximately 13 years old
scored a 2 on the Henneke Body Condition Scoring Chart and it was
also determined the horse was lame.

The owners claimed that the vet had been out to float the horse's
teeth 4-5 weeks ago and the vet had scored the horse, "a near perfect
4". When asked if the defendant knew what the Henneke Chart was, the
owner refused to answer the question and kept repeating that the vet
had scored the horse a near perfect 4 and she listened to the vet.

The vet, when shown pictures of the horse taken at the end of June
2008 when the PSP investigated the complaint, agreed that the horse
was a 2 - 2.5 down from a "near perfect 4" when the vet floated the
horse's teeth at the end of May 2008. In other words from the end of
May until the end of June, a matter of 4-5 weeks, the horse LOST
weight!.

A second horse wearing a heavy nylon halter chained with a heavy tow
chain to a large piece of wheeled equipment. The gelding was in
acceptable body condition but had a wound in the shoulder area
covered in flies and draining pus and blood. The horse did not allow
investigators to touch the wound, pulling away and pinning his ears.

The PSP instructed the owners to call a vet to determine why the
chestnut paint horse was in poor body condition and to determine the
lameness issue. The Trooper instructed the owners to call the vet
regarding the shoulder injury. PA law, Title 18, 5511 (c) requires
that animals be provided with necessary vet care, thus law
enforcement has the authority to require owners, or those who have
duty of care, to provide necessary vet care for the horse in question
to address why the horse is in a condition that has resulted in a
criminal investigation. PSP also instructed the owners to clean the
wooden structure because it was not in sanitary condition, and that
the structure was in need of repair before it would qualify as
shelter under the law.

The wood structure's walls are non-existent on some sides and the
sunlight shines in through the open roof. The "aisle" is littered
with barrels, ladders, junk, and other equipment. The horse's are
maintained in a flood plain filled with dead and dying trees, the
majority of which are denuded of bark. The chestnut gelding wanders
loose only a few hundred yards from a busy two lane state road. Years
ago another horse was killed on the same road in the vicinity of the
owner's property.

The owners' attempt to clean the "shelter" resulted in a worsening of
the situation. The owners declined to spend the funds necessary to
diagnose and treat the lame horse. The horse's body condition did not
improve, the premises remained in the same condition, littered with
junk, and the owners failed to follow the recommendations of their
own vet, leaving PSP with no choice but to file the cruelty charges.

In court the owners tried to lay blame on their vet, stating that the
horse refused to eat anything, even an apple cut in small pieces,
after the vet had floated the horse's teeth to address his wave
mouth. As for the lameness issue, the owners contradicted the vet
claiming that the horse's lameness was improving. The owners gave no
reasons for failing to address the issue of the 2nd horse's 8" wound
draining pus and blood. The owners claimed that they had not been
informed of a problem with the shelter.

The defendant Heiser, was in the same court in 2007 charged with
cruelty because her horse's ribs, hipbones, and spine were clearly
visible from the highway. The PSP responded to complaints regarding
the starving horse. Heiser failed to contact the PSP in regards to
their investigation, choosing instead to hire a defense attorney.
Heiser showed up in court in 2007 with pictures demonstrating her
horse had gained weight. Her explanation for his weight loss
was "moldy hay" stating her father had called her, "telling her the
horse had lost weight and the hay was moldy". According to the
defendant, she called the vet who instructed her to buy feed at the
feed store to feed the horse. The Judge Court ordered the defendant
to have a vet examine the horse to confirm that the horse was in
satisfactory condition. The Judge admonished the defendant, stating
she never wanted to see her in her courtroom again.

What Can You Do?

We need to demonstrate to the criminal justice system that horse
cruelty is a crime that the Public wants enforced. I know everyone is
busy, but if this issue is important to you, take the time and write
a short thank you. Over the years that the EPN has been working to
see the cruelty law enforced, we have urged people to send letters of
appreciation and many people have taken the time to send a short
note. These letters do make a difference, so please take the time to
send a short note for the horses.

Please show your appreciation to the PA State Police, the District
Attorney, and the Courts by sending a letter thanking them for a job
well done. Refer to the horse cruelty case, Heiser and Schaeffer
defendants. Title 18, 5511(c).

*** WARNING *** This is crucial info for Paint Horse owners in Miama, Florida,
but the info is disturbing!

NetPosse has received information from law enforcement and private citizens that
PAINT HORSES are being STOLEN in MIAMI, FLORIDA. The pattern shows that paint
horses are deliberately being targeted ... but they are not the only stolen
horses in the area! However, we need to make paint horse owners aware of this so
that they can be PRO ACTIVE in protecting their horses. This is a horrible
notice to post, but it must be done ...

From one officer in Miami 3/8/09: ... a horse was stolen on 2/27; the horse was
located on 3/5/09. It apparently was walked down the street to private property
and slaughtered. The owner bless her heart was on scene when I arrived. The
media was also on scene ... I was wondering have you ever encountered Paint
horses being used for any rituals or sacrifices. I have noticed the horses that
we have located slaughtered are all paints coincidence I don't think so. This is
the first horse that was found where it could be identified by the owner.

From a horse owner with a missing paint 3/3/09: We are having a real problem
down here in the Redlands with stolen horses. The head and hooves show up in

Dark Brown Whitman English Saddle was stolen during a horse expo at Battle Arena
in Tunica sometime between Friday and Saturday - Feb 20/21, 2009


This saddle belonged to a clinician and was in her trailer parked by an arena
door. She uses this saddle in her demos and really needs to get it back!

transit after being shipped from a UPS store in Silver City, NM, back to the
company in Oakland, CA, on May 6, 2009.

The label was switched with a toilet tank from Home Depot.


REWARD offered for info leading to recovery. Someone could have unknowingly
purchased this saddle.

Dan was lost in Botetourt County, VA, on Saturday, May 23, 2009 in the Camp
Bethel/Fringer Trail area - he is completely tacked!


Help Candace find her red lineback dun - he has a blaze (with a "C" on left side
notched out) and a left back sock (1/2 stocking). Dan is stocky - at 14.2 hh and
1,000 lbs.

We do not suspect foul play at this time and we are hoping she will be found
before something terrible happens. It is possible someone has the horse and does
not know where he belongs. It is also possible someone may find her and take
advantage of the situation.

EPN Sanctuary Program Accepts Former Champion Hunter-Junior
EPN Assists PA State Police on Cruelty Investigations

The EPN Sanctuary Program has accepted Junior, a former champion hunter on the
"A" Circuit into our program. Rather than put Junior down before his time, his
owner approached the EPN. Due to health issues resulting in exhorbitant medical
bills Junior's owner, who has cared for his mother and who created Junior 17
years ago is no longer able to care for him. The EPN could not stand by and
watch a responsible owner forced to kill their beloved horse due to health
reasons, especially while we read every day about how irresponsible owners,
owners who inflict pain and suffering on their horses, are given money because
they have abused their horses. We felt it was time to step up and help a
responsible owner.

The EPN has advocated for owner responsibility and accountability since its
inception. Responsible owners are urged to put their horses down, while
irresponsible owners are rewarded with money given to them by dealers and
rescues to purchase their neglected horse. It is almost unheard of to read about
a rescued horse whose owner was held accountable for their failure to care for
their horse. Instead the news story tells readers about how a rescue saved a
horse from neglect, the horrible conditon the horse was in when rescued, and
please send funds to care for the horse. The reader is never informed of what
happened to the owner for their failure to provide necesssary food, water,
shelter, and veterinary care.

The horse owned by the irresponsible owner is saved, while the horse owned by
the responsible owner receives a death sentence. When are we going to start
holding owners accountable for the neglect? When are we going to reward or
assist responsible owners when they need assistance?

Junior needs sponsors to help cover the cost of food, vaccinations, worming,
dental and farrier care.

$20.00 a month or $240.00 a year will cover the cost of all his vaccines and
wormer, and dental care.

$40.00 a month will cover the cost of providing Junior with front shoes which he
really prefers to have rather than being barefoot.

$50.00 a month will help cover the cost of Junior's hay and senior feed which he
needs in the winter.

Fortunately for Junior, horse owners have donated horse blankets and other horse
equipment for Junior to utilize.

EPN Assiste the PA State Police in Cruelty Investigation

The EPN has again assisted the PA State Police in a cruelty investigation
involving several horses including mares and foals, and stallions. All of the
horses in question were scored a 1 or a 2 on the Henneke Body Condition Scoring
Chart. The owners has been arrested by the PA State Police on 7 counts of
cruelty to animals, Title 18, 5511 (c). A hearing date has yet to be set.

All of these horses are supposedly well bred paint and quarter horses with team
penning and cutting horse bloodlines.

This case is another example of the local SPCA being aware of the problem for
years and doing nothing resolve the situation.

The EPN assisted PSP in another horse cruelty case that resulted in the owners
being fined $500.00 each in the Schuylkill County Court of Common Pleas.

60 Horses in Cruelty Cases - Help Needed

The EPN is assisting the PA State Police in 3 cruelty cases involving at least
60 horses. In all of the cases the owners have allowed stallions to
indiscriminately breed mares and their offspring. Charges have been and many
more are possible in thesecontinuing investigations. Several horses are paints
and quarter horses, some bred fo team penning & cutting.

What is needed:

Funds to cover the costs of medical care,transport,and boarding fees.

Medical care per horse is estimated at $500.00 per horse to get started with
examinations, bloodwork, fecals, dental, and vaccinations. Not included in this
estimate is farrier care.

We are looking at a minimum of $1000.00 per horse for the first month in medical
care, farrier, dental, board, and transport. Remember these horses re evidence
in a criminal investigation and evidence must be collected to document the
neglect.


Qualified facilities to house and care for the horses if they are surrendered
voluntarily, taken into custody with a search warrant, or ordered forfeited by
the Court.

Horse Cruelty Case Update - Donations & Homes Needed NOW!

The EPN appreciates the PA State Police's professional and swift response to
this situation. Due to the history of 12 horses dying in 5 years, the EPN felt
it was IMPERATIVE to get as many horses as possible out of the situation ASAP.

The EPN appreciates all the assistance and support from Stone Mountain Tack,
Another Chance 4 Horses, Shauna McGovern, and others who literally dropped
everything they were doing when the call came in to move these horses NOW!

The EPN is hoping that members of the Paint Horse Association & PA Paint Horse
Club will also assist the EPN by helping to raise funds and find homes for these
Paint horses who are not as fortunate as those owned and loved by Paint Horse
Association/Club members. In 2009 the EPN has assisted the PSP in horse cruelty
cases in Schuylkill County involving 23 horses, 19 of who are Paint horses.

The following news story is from the Pottsville Republican. One correction to
the story, 12, TWELVE HORSES, have died at the property in the past 5 years, not
five.

The 5 horses voluntarily surrendered to the PA State Police and cared for by the
EPN, have had a physical exam, blood work, teeth examined, Coggins Test, and
Fecals at a cost of $1000.00. The bill was paid by a person willing to max out
their credit card in the belief that the Public would come through and donate
the money to cover the cost. The horses still need teeth floating, farrier care,
vaccinations, deworming, pregnancy exams, and the colt castrated, estimated to
be another $4000.00. These 5 horses are evidence in a criminal investigation,
but since they have been voluntarily surrendered by the owner, they can be
adopted.

The horses are being housed at a private farm. If the EPN receives $225.00 in
donations by Monday morning, the horses will have their feet trimmed by the
farm's regular farrier who is scheduled for a routine farm visit on Monday.

All are paints, 1 gelding, 1 colt, and 3 fillies ranging in age from 1.5 - 2 to
4 years old. All have been handled and have nice attitudes, the vet even
commented on their behavior. Their body score ranges from 2 to 3 on the Henneke.

Please be patient for more information. There are cruelty charges pending and
when the case goes to court those questions will be answered. Right now we need
donations to cover the cost of vet, farrier, transport,and board bills estimated
to be $10,000 for the 1st month.

AC4H is assisting in the placement and adoption of these horses, so please
contact AC4H regarding applying to adopt these horses.

The EPN is assisting the PA State Police in another horse cruelty case in the
vicinity involving paint horses and an owner who cannot seem to keep their
stallion away from the mares. The availablilty of slaughter has not helped these
horses. These owners are lazy, irresponsible and have this idea that they can
make money breeding these horses and selling them.

POTTSVILLE REPUBLICAN STORY


ORWIGSBURG - Five horses were taken from a property in Orwigsburg - with animal
cruelty charges pending against their owner, according to an official from the
Equine Protection Network.

Four more horses remained on that property as of Friday afternoon, said
Christine Berry, president and founder of the Friedensburg-based equine network.

Berry said the horse owner's name was not being released pending further action.

Berry said the group tried to take all nine horses but the owner was only
willing to give up five.

"He has relinquished five of the horses to us but there are still four out there
that are in worse shape than these," Berry said. "He has 24 hours to get a
veterinarian out there to get them taken care of or he may lose those as well."

An e-mail from Another Chance for Horses, based in Bernville, alerted the Equine
Protection Network to the situation at the Orwigsburg property. Berry met with
the horse owner and Schuylkill Haven state police on Thursday and the horses
were taken Friday afternoon.

Berry said the horses are underweight and were standing in their own feces and
urine, with no bedding provided in the stalls. Most had burdocks, a sticky weed,
in their manes and tails, she said.

"That is common in neglect cases," Berry said. "The horses are turned out in the
weeds instead of a pasture."

Dr. Travis Boston of Willow Creek Animal Hospital, Reading, examined the animals
Friday.

"There is no systemic disease, but there are signs of neglect including
malnutrition and emaciation," Boston said.

Boston said what bothered him most about the animals was their age.

"These horses are between 2 and 4 years old. They would have had 25 to 30 years
of neglect if they weren't seized," he said. "Usually these cases involve much
older horses."

Berry said the owner has a history of neglecting animals and that five horses
died in the last six years on his property.

Berry said the equine group is looking for homes or donations to help care for
the animals.

"We have paid over $1,000 already and we only have them one day," Berry said.
"It will cost us about $10,000 a month to care for them and we don't have that
kind of money."

Per the vet's recomendation all have been dewormed with double strongid. They
are enjoying salt blocks, clean stalls, water, and hay. A volunteer spent
Saturday grooming the horses and removing the burdocks from their manes.
Hopefully the tails will soon look like tails again.

The private farm where they are housed has their farrier on the farm today for a
regularly scheduled appointment. If the EPN receives $225.00 in donations before
the farrier is done, the horses will have their feet trimmed. The EPN does not
have the funds to cover the cost. We have already spent $1000.00 on vet care and
there is still much work to be done, the estimate is close to $4000.00.

Teeth floating - $500, deworming, vaccinations, castration, more bloodwork,
pregnancy exams on the fillies, castration of the colt.

These horses are evidence in a criminal investigation, only vets can administer
the vaccinatons so we have to pay the full cost.

No Support for Enforcement

1 week and two thousand dollars later the EPN has received $180.00 in donations
for the cost of caring for the 5 horses surrendered in the horse cruetly
investigation. Remember these horses are EVIDENCE in a cruelty case and as such
their care must be documented. All of their care & tests are evidence to be used
in court to convict the owner.

We have received adoption applications which are being processed, but that does
not cover the cost of their care. These horses will still need to have blood
work done before court, which will be an additonal $500.00. More photos will
have to be taken and developed for court.

We are due in court on the 21st in another cruelty case involving mares, foals,
and stallions, several of who scored a 1. If and when the owner is convicted and
the Court asks about what should happen to the horses, I will have no choice but
to tell the Court there is NO MONEY & NO PLACE for them to go.

There are no people trained in the Rules of Evidence and Rules of Criminal
Procedure who are willing and able to care for these horses. There is no
facility to house the horses. These horses will need $5000.00 in vet care to
collect the evidence for court and to care for them. I already have the estimate
from the vet, and that is just to get started. The vet will need to examine and
draw blood on these horses as SOON AS THEY ARE TAKEN INTO CUSTODY, NOT HOURS OR
DAYS LATER. Before ANYTHING is done to these horses, blood & fecals must be
drawn because it is evidence and if the chain of evidence is broken, the defense
attorney will challenge it and have it thrown out of court.

When we go to court on the 2nd case, the one where the owner surrendered the 5
horses and still has 4 in his "care" I will be forced to tell the Court the same
thing.

In a third case involving a horse with a shoulder wound who needs surgery, I
will tell the ADA there is no place & no money for him either, so he can slowly
die in his filthy flood plain.

So these 16 horses will continue to be neglected until the owner sells them &
then a rescue will reward the owner, and in essence, pay their court fine. They
will be SAVED!

As for the 5 horses we are out of hay to feed them and after going into debt to
the tune of two grand to pay for them, I will not pay one more cent. I have
spent $1500.00 to collect the evidence to prove neglect in a court of law beyond
a reasonable doubt.

Why is a private citizen paying to collect evidece in a criminal case???

Forget going to the Commonwealth of PA, they have not passed a budget, 90 sme
days past the deadline.

Remember these horses are evidence in a criminal investigation & if not held
according to the Rules of Evidence & Criminal Procedure, the evidence will be
thrown out of court & the owner will walk away.

It costs money to prosecute a cruelty case and no one wants to pay the cost. The
PA Cruelty Law, Title 18, 5511c, MUST be upgraded to at the minimum a
misdemeanor or a felony. Then it will justify the expenditure of the resources
needed to successfully prosecute the owners of these animals. Because it is a
non-traffic summary, law enforcement is not willing to expend their limited
resources. There is simply not enough "bang for the buck"

This is the last cruelty case I will assist on. I have helped on 3 cases where
the SPCA did nothing & horses died. The local SPCA took in over $600,000.00 in
2008, th EPN took in less than $5000.00.

People came to the EPN because they knew we would get something done. We did,
but no one wants to help cover the costs.

At the conclusion of these cases, the EPN will no longer respond to any horse
welfare issues. We will care for the 2 horses in the Sanctuary as long as we
can. As for the horse welfare- It is a LOST CAUSE. SAME AS THE SLAUGHTER ISSUE,
IF THEY CANNOT PASS A BILL WITH A DEMOCRATIC PRESIDENT & A DEMOCRATIC CONGRESS,
THEN THEY WILL NEVER PASS IT.

By the way, the availability of slaughter has DONE NOTHING to help these horses
who have been neglected for YEARS. Slaughter if anything has created a market
for the product of indiscriminate backyard breeding.

The wild horses are a lost cause also. If the round-up of the most famous wild
horse, documented in books, the subject of an award winning documentary &
immortalized by Breyer, and with thousands of Americans objecting to his
round-up can be rounded up, then just what can all these wealthy animal welfare
groups accomplish???

They are wealthy enough to be te most powerful lobby in Washington, but they are
not....none of them are willing to play the game the way the lobbies who have
their voices heard play the game.

I for one can no longer bear to watch.

Keith is going to Missouri even though they may not be able to pick up Max for a
day or so... Susan asked me to ask if anyone near Springfield MO would have a
place they could stay for a day or two. They will have a mare with them. His

After 58 weeks Max has been located because of what is believed to be by Keith
to be a Stolen Horse International Flyer!!!!!!!!!!!
