I had prepared to present and discuss an example of license terms and conditions that members might adopt when submitting images to the Lake of the Ozarks Convention & Visitor Bureau in exchange for their providing us (the Club) with an ad for the next year promoting the Lake Arts Photography Club. As most of you know, we were locked out of the meeting facilities and thus unable to hold our meeting for this month.
So, I thought instead, I would provide an email and include the sample terms along with some ideas related to the topic.
I want to make it clear that this is my own opinion and is not to be considered as legal or accounting advice nor am I suggesting that club members are required to use these terms. What I am providing is an example only and is offered to help you think through the process. These terms are very similar to what I will be requiring for any images that I submit to the Bureau.
Below are two sets of licensing terms. The first provides the licensee with rights to use the licensed images in print materials while the second set of terms provides for the same use on their website and via electronic means. I think these terms will provide for all that Bureau will want to do with the images.
The terms are somewhat broad except for the duration limit of 1 year. I think that the 1 year limit is appropriate given that the advertisement is also limited to 1 year.
In addition to the two usages (A and B), I will also include language that specifically restricts the Bureau from distributing the images for use by third parties or for use to promote or endorse third party products and services and further indicates that usage must be in the spirit of the mission of the Bureau, for promoting the Bureau itself and/or the greater Lake of the Ozarks region as a destination for travel and tourism.
These terms were generated using the PLUS (Picture Licensing Universal System) Media Selector and the PLUS Decoder. I highly recommend that club members become familiar with the PLUS system if you license any images to others. It has quickly become a standard for the industry. Remember, your images have value. It is important that both parties have a clear understanding of what is allowed and how images may be used.
