JCT: Just when I appealed for support in trying to create a
new Ontario party, someone at my ISP switched my email ID
from
turmel@... to
turmel@... and so none
of my messages to many groups were recognized. At the very
same time, I started getting rejections for cross-posting to
too many groups. Going directly to Yahoo didn't help since
they have a limit on the number of groups. So I have to drop
your group. Make sure to send a thank-you message to
support@yahoogroups.com

ONTARIO COURT OF APPEAL DECISION?

JCT: On Tue Sep 23 2003, Brian McAllister wrote in a post
called "A decision Friday"
Notice: To be posted on the Court's website at 10:00 a.m. on
Friday, September 26, 2003, decisions in Hitzig et al. v.
Her Majesty the Queen, Parker v. Her Majesty the Queen,
Parker et al. v. Her Majesty the Queen, R. v. Turmel, and R.
v. J.P.
On July 29, 30 and 31, a panel of the Court of Appeal for
Ontario, composed of Justices Doherty, Goudge and Simmons,
heard these seven appeals from decisions of judges of the
Superior Court of Justice, in relation to the constitutional
validity of the Government of Canada's scheme for
establishing medical exemptions from the prohibition on the
possession, and in some cases, production, of marihuana
contained in the Controlled Drugs and Substances Act. The
panel will release its judgments in these appeals on Friday,
September 26, 2003.
JCT: Talk about a wonderful break. One week before my
provincial election and I might win a writ of prohibition
forcing all marijuana charges to be dropped in Canada. I
figured it should help somewhat But then, on Tue Sep 23
2003, Brian_McAllister said:

I saw the announcement this morning, but when I returned to
the website to link to it, the announcement was gone. I'm
not sure what to make of that. I would also say that I
expect the court's decisions will not be clear. I suspect
that they will decide that the government failed to properly
address the constitutional problem by July 31, 2001 (so
therefore there was a period of invalidity). However, I also
expect that they will craft the decision in such a way that
allows the prohibition to be reinstated without the passing
of new legislation - and that perhaps the prohibition was
effective once again as of July 8, 2003 (ie. the date the
government started - allegedly - distributing pot).

JCT: What's going on? Did someone tell the court to delay
their decision until after the election? Let another 75
epileptics die? Or until the govrernment brings in the new
prohibition while Marc Emery keeps everyone distracted
partying over the short-lived win?
Regardless, as soon as information comes down, I'll report.
If I don't win everything, then the battle goes to the
Supreme Court of Canada. If I do, you may hear about it.
