It's possible that they are "Moth Flies" also known as "Drain Flies" (Family: Psychodidae). The picture is kind of dark and there's nothing for scale to gauge the size. Some species of are known to frequent sink/tub drains containg hair and other stuff. They are small fuzzy looking flies and greyish-brown in color. No big deal, just clean your drains really well.

As michelle told you, they're Psychodid flies. They are not related to fruit flies whatsoever. http://en.wikipedia.org/wiki/Psychodidae To get rid of them...
