Call IBM. IBM owns the software. IBM sets
the rules for their software.

I don't believe that IBM normally licenses
zOS to run specifically under Hercules. If you
purchase a current IBM main frame, I see no
reason that you couldn't run Hercules in a
full function LPAR. If zOS is licensed for
the LPAR, zOS could probably legally run under
Hercules on that LPAR?

Why do you think that you might be able to
run zOS under Hercules? Are you or your
company wealthy? Are you an IBM employee?
Are you or your company IBM business partners?
Is there some other reason that you feel you
can use to license zOS?
