Request for Assistance to Firefighter Grant (AFG) Peer Reviewers

The IAAI is seeking 36 U.S. members in good standing to serve as peer evaluators for the Assistance to Firefighters Grant (AFG) program.  While you will not be compensated as a reviewer, the Department of Homeland Security will cover travel costs, food and lodging. 

 

Grants Management is expecting a similar number of applications to be reviewed in 2009 as we had in 2008.  Therefore, we request 12 evaluators for each week for a total of 36 volunteer peer evaluators for the three 1-week review periods.

 

The evaluation periods are scheduled as follows with all evaluations taking place at the National Emergency Training Center (NETC) in Emmitsburg, Maryland.

 

       May 4-8                 Evaluation Group 1

       May 11-15             Evaluation Group 2

       May 18-22             Evaluation Group 3

 

Individuals volunteering to serve as evaluators should plan on traveling the day before the evaluation period and returning home the afternoon of the last day of the evaluation period.  Travel costs will be reimbursed, and food and lodging will be provided at NETC.  A support contractor will contact our selected volunteers to discuss the necessary travel arrangements and reimbursement if a privately owned vehicle is being used.  Transportation will be provided between the airport and NETC.  No salary is authorized for personnel volunteering to evaluate the Assistance to Firefighter grant applications.  Please be aware, for planning purposes, volunteer evaluators will be scheduled for the entire week.  Grants management procedures prohibit interchanging evaluators during any given week.

 

The IAAI requires that all reviewers be members of the International in good standing. They must possess knowledge about fire department apparatus, equipment and training. Members should have experience as members of apparatus committees or in equipment purchasing or in fire department management roles. Preference will be given to members who have never served as a Peer Reviewer.

I have not had any incidents involving this type of liquid as an accelerant. Two courses of direction for you to go:
 
1)  Conduct your own tests to establish the Hypothesis
2)  Put the question on the IAAI or Fire Findings Forums.
 
The liquid may contain alcohol but your tests will confirm the ignitability an ignition temperatures.

Thank you for your interest with this.  I am in the process of doing some testing to see if I can determine one way or another this theory if you will call it, that Old Spice can be used as an accelerant.  I am also going to conduct it to see if an Accelerant K9 could in anyway detect it.

Open Letter to IAAI Membership

 

Dear Member,

 

In the July 2009 edition of the Fire and Arson Investigator (Volume 60, Number 1) an article entitled “Do not take “No Entry” for an Answer: OSHA Hazwoper Training Requirements Are Not Applicable To A Fire Investigator’s Duties And Functions At the Fire Scene” authored by William A. LeMire was published.  In the byline it notes that Mr. LeMire serves in a volunteer capacity as General Counsel for the IAAI. This article was not intended to be nor should it be interpreted as the official position of the IAAI nor should it be considered a policy statement of the IAAI.  I have spoke at great length with Mr. LeMire and it was his intent to provide his opinion and interpretation based on the reading of an OSHA interpretation letter regarding the applicability of 1910.120 to fire investigators and the appropriate OSHA guidelines.  His conclusions were drawn from this review and analysis.  Mr. LeMire stands firmly behind the opinions proffered in the article but it was not his intent to suggest that fire investigators are free from any safety requirements or possible OSHA oversight.

 

The interpretation letter authored by OSHA was prepared as a result of a request for interpretation regarding the participation in certain fire scene documentation processes where hazardous materials may or may not be present.  As all fire scene investigations are unique and contain a myriad of potential hazards, we believe it would be in the best interest of the IAAI and its membership to reframe this interpretation request in a broader context specifically asking OSHA for interpretation of the applicability of 1910.120 and other safety provisions to a number of different fire scene scenarios.  The crux of Mr. LeMire’s article was that HAZWOPER requirements do not typically apply to the duties of a fire investigator after the emergency response is over and that there are serious questions about who has the authority to exclude investigators from a scene based on lack of safety training or credentials. 

 

This is a very passionate issue, primarily in the private sector and we hope through further analysis and interpretive documents we may provide an even clearer picture of who ultimately has or does not have this type of authority.  Health and Safety are certainly primary concerns of the IAAI and interpretations relative to health and safety issues demand clarity.  Mr. LeMire has offered to assist the IAAI in seeking that clarity from OSHA. The IAAI remains committed to ensuring that fire investigators and their employers receive the clearest information and interpretation so that sound safety practices and policies are developed and implemented.

The IAAI is seeking 12 U.S. members in good standing to represent the Association as peer grant reviewers for the Staffing for Adequate Emergency Response (SAFER) Grant National Emergency Training Center (NETC) in Emmitsburg, Maryland for each of the two week-long evaluation panels.   The grant review will take place on January 11-15, 2010 and January 18-23, 2010. Reviewers must be able to travel on the day prior to the evaluation week and the afternoon of the last day.  While you will not be compensated as a reviewer, the Department of Homeland Security will cover travel costs, food and lodging.

Attached is the Report on Proposals for NFPA 921 which is in the Fall 2010 Revision Cycle (meaning amending motions have to be filed by 10/22/09 in order for the document to be acted upon at the 06/12-15/11 NFPA Technical Meeting).  Several chapters have been entirely rewritten.  I encourage all to look at the re-write of Chapter 18, proposal 921-41, log # CP10, beginning on page 921-50 which is actually page 63 of the 118 page document.  There are obviously other proposals or rewrite of entire chapters which will be of interest to some of you.  The deadline for submitting comments on these proposals is March 5, 2010, and I strongly recommend that you review the process for making comments before submitting any comments.  As you will see in a review of the ROP, several proposals were rejected for not complying with the process, such as not including text to replace any original text whose deletion was suggested.  A printable comment form is on page 9 of the ROP and a sample submission is on page 8.

Attached is the Report on Proposals for NFPA 921 which is in the Fall 2010 Revision Cycle (meaning amending motions have to be filed by 10/22/09 in order for the document to be acted upon at the 06/12-15/11 NFPA Technical Meeting).  Several chapters have been entirely rewritten.  I encourage all to look at the re-write of Chapter 18, proposal 921-41, log # CP10, beginning on page 921-50 which is actually page 63 of the 118 page document.  There are obviously other proposals or rewrite of entire chapters which will be of interest to some of you.  The deadline for submitting comments on these proposals is March 5, 2010, and I strongly recommend that you review the process for making comments before submitting any comments.  As you will see in a review of the ROP, several proposals were rejected for not complying with the process, such as not including text to replace any original text whose deletion was suggested.  A printable comment form is on page 9 of the ROP and a sample submission is on page 8.

Detective Grimm served as a police officer in the Middletown Township, N.J. Police Department for 37 years, prior to his retired in 2008.  Barry attained the rank of Detective First Class in the Major Crimes Unit; in addition he was a forensic identification specialist and fire/arson investigator for the Department.    Detective Grimm provided technical, photographic and laboratory assistance in almost every significant investigation, including homicides, sudden deaths, burglaries, narcotics offenses and fire investigations.

 

Since 1985, Barry has been an Adjunct Instructor for The National Fire Academy in Emmitsburg, MD., teaching numerous courses offered in the Arson Curriculum, specifically Interview/Interrogation Courtroom Techniques, and Fire/Arson Investigation. He had been selected by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) as a subject matter expert in the redevelopment of the former Fire/Arson course offered at the National Fire Academy, and has been one of the primary instructors since the initial offering in July 2007. Most recently Barry was requested to be a subject matter expert in the development of the Forensic Arson Evidence Course offered at the NFA, and taught the initial pilot offering in July 2009. Barry has appeared on CFItrainer.net and is an SME in the IAAI evidence curriculum. Barry has provided training courses and spoke at various training seminars and conferences across the county.

Rule 26: Major Changes for Attorneys and Experts

A major revision to the federal rules governing expert witness reports is on track to take effect in December. Lawyers and experts alike agree that the changes are long overdue.

 

No longer would Rule 26 of the Federal Rules of Civil Procedure allow full discovery of draft expert reports and require broad disclosure of any communications between an expert and trial counsel, as has been the case ever since the rule's revision in 1993.

 

Instead, under proposed amendments to Rule 26, those communications would come under the protection of the work-product doctrine. The amendments would prohibit discovery of draft expert reports and limit discovery of attorney-expert communications. Still allowed would be full discovery of the expert's opinions and of the facts or data used to support them.

 

The changes were approved by the U.S. Judicial Conference in September and submitted to the Supreme Court. The Supreme Court is expected to approve the amendments by May 1 and submit them to Congress. Unless Congress rejects the rules, they will take effect on Dec. 1, 2010.

 

The proposed rule is broadly supported by trial lawyers and bar organizations as a step towards reducing the cost and contentiousness of litigation.

 

Organizations that endorsed the rule include the American Bar Association, American College of Trial Lawyers, American Association for Justice, Defense Research Institute, Federal Magistrate Judges’ Association, Lawyers for Civil Justice, Federation of Defense & Corporate Counsel, International Association of Defense Counsel, and the U.S. Department of Justice.

 

Dual Sets of Experts

 

"Lawyers and experts take elaborate steps to avoid creating any discoverable record and at the same time take elaborate steps to attempt to discover the other side’s drafts and communications," the Judicial Conference explained in its report to the Supreme Court.

 

"The artificial and wasteful discovery-avoidance practices include lawyers hiring two sets of experts – one for consultation, to do the work and develop the opinions, and one to provide the testimony – to avoid creating a discoverable record of the collaborative interaction with the experts."

 

The proposed rule would expressly provide that the work-product protection applies to "protect drafts of any report or disclosure required under Rule 26(a), regardless of the form in which the draft is recorded."

 

The proposed rule retains the three categories of attorney-expert communications that are excluded from the work-product protection under the existing rule:

 

1.         Communications pertaining to the expert's compensation.

 

2.         Facts or data that the attorney provided and the expert considered in forming opinions.

 

3.         Assumptions that the attorney provided and that the expert relied on.

 

In another change, the proposed rule would alter the procedure for witnesses who will provide expert testimony but who were not specifically retained to provide expert testimony. Treating physicians and government accident investigators are examples of this category of expert.

 

Under the proposed rule, if the expert is not required to submit a written report, then the lawyer who will use the testimony must submit a disclosure summarizing the facts and opinions to which the expert is expected to testify.           

 

Support from Both Sides of the Bar

 

Stephen B. Pershing, a lawyer with the Center for Constitutional Litigation in Washington, D.C., submitted testimony in favor of the proposed rule on behalf of the American Association for Justice. He said that plaintiff and defense lawyers agree on the need to apply work-product protection to expert draft reports.

 

"Practice under the 1993 expert discovery amendments has become preoccupied with a search for counsel's work product, or counsel's manipulation of the expert's output that takes up time better spent focusing on the expert's conclusions themselves," Pershing said.

 

The amended rule would enable litigants to avoid the kind of "artificial behavior" that is now all too common, he suggested. No longer would lawyers and experts feel compelled to avoid written communications and no longer would well-funded litigants hire two sets of experts, one to consult in case development and the other to testify.

 

Another who spoke in favor of the proposed rule is Wayne B. Mason, former board chair of the Federation of Defense & Corporate Counsel and a partner in the Dallas office of Sedgwick, Detert, Moran & Arnold.

 

"Attorney discussions with experts are too often forced to be verbal in an effort to discourage discovery of draft reports," he said. "The proposed rules supply a well-reasoned approach that strengthens the veracity and straightforwardness of the discovery process while considering the burden and expense."

 

Mason praised the proposed rule for extending the work-product protection to employee-experts who are not required to prepare a written report. "Facilitating open communication between attorneys and in-house witnesses is an important practical consideration for the committee."                       

 

Rule Would Reduce Costs

 

John H. Martin, a past-president of the Defense Research Institute and a partner with Thompson & Knight in Dallas, said that the proposed rule will help reduce the cost of litigation.

 

"The proposed amendments provide protection to attorney-expert communications that allows the attorney and the expert to communicate freely with each other without having to engage in time-consuming and wasteful measures to avoid the creation of a draft report," Martin said.

 

"This allows the attorney to learn about the scientific or technical aspects of the case from the expert so that legal arguments not based on sound scientific methodology can be discarded, and the issues to be presented at trial can be narrowed," Martin added. "At the same time, it allows the attorney to speak freely with the expert, many of whom are not fulltime professional expert witnesses, and to engage in an ethical preparation of the witness to present opinion testimony."

 

It appears that the proposed rule extends the work-product protection to not just the expert, but also to the expert's employees. The official Committee Note that accompanies the proposed rule explains that its protection is intended to include communications "between the party's attorney and assistants of the expert witnesses."

 

A number of lawyers had urged the committee to take this position. "An expert engineer at MIT may use grad students in his doctoral program to assist him in his research," explained R. Matthew Cairns, president-elect of the Defense Research Institute and a lawyer in Concord, N.H., "and those students are the ones that counsel may deal with on a day-to-day basis as the expert's team does his testing and analysis prior to him reaching a conclusion and preparing a report." Given the broad support for the proposed rule by lawyers and experts alike, the changes to Rule 26 are virtually certain to take effect Dec. 1.

The IAAI is seeking 24 U.S. members in good standing to represent the Association as peer grant reviewers for the FY 2010 Assistance to Firefighters Grant Program (AFG) at the National Emergency Training Center (NETC) in Emmitsburg, Maryland.  The grant review will take place on June 21-25 and reviewers must be able to travel on June 20.  While you will not be compensated as a reviewer, the Department of Homeland Security will cover travel costs, food and lodging.

Missouri Fire Investigators Seek Information
on Similar Incidents:

 

On May 11, 2010, between 9:30 p.m. and 11:30 p.m. four tractor-trailer trucks were set on fire while parked at truck stops in Kingdom City , Missouri.  In each incident, the truck operator was asleep inside the truck’s sleeper when the fires were set, but fortunately no injuries resulted.

During this investigation, information was obtained indicating a similar fire occurred during the early morning hours of May 7th  in Oakgrove, Missouri. The operator of this vehicle was also inside the sleeper at the time of the fire.

Additionally, information has been received indicating other trucking companies have experienced similar occurrences in other states.

 Judge Rejects Insurance Company's Bid to Use 'Fire Modeling' Results at Trial

In an insurance dispute involving a 2006 residential fire, a Nassau County judge has barred the defendant insurance company from introducing the results of a computerized "fire modeling" program,

which purportedly corroborate the company's claim that the fire was deliberately set.

State Farm Fire and Casualty Company sought to introduce the testimony of a University of North Carolina at Charlotte

professor regarding the findings of a Fire Dynamics Simulator model of a fire at the Bethpage home of plaintiff Albert J. Santos.

In a decision last week, Nassau County Supreme Court Justice Thomas P. Phelan (See Profile) excluded that testimony, finding that computer fire models have not yet been accepted by the relevant scientific community.

"Bearing in mind that the court's role as gatekeeper is 'counting scientists,' the court finds that defendant did not present sufficient evidence to establish that there is a consensus in the fire investigation community that computer fire modeling is generally accepted as reliable," Justice Phelan wrote in Santos v. State Farm Fire and Casualty Company, 00790/07.

The Nassau Supreme Court decision appears on page 42 of the print edition of today's Law Journal.

The scientific standards for determining the origins and dynamics of fires became a national issue last year, following an article in the New Yorker magazine about the execution of a Texas man for a fatal fire he may not have caused.

In the case before Justice Phelan, there were no injuries, but the plaintiff sought approximately $600,000 for the loss of his home and property.

State Farm declined to pay on the grounds that the fire appeared to have been deliberately set.

Along with other evidence, the insurance company sought to introduce the testimony of engineering professor Jozef Urbas, an expert in fire safety,

who would testify regarding the results of the Fire Dynamics Simulator,

The FDS, as the model is known, is "a computational fluid dynamics model of fire-driven fluid flow," according to the Web site for the

U.S. Department of Commerce's National Institute of Standards and Technology.

The model simulates the growth and spread of a fire based on such factors as the furnishings, the walls, the floors and the ceilings.

Mr. Santos moved to exclude the use of the computer model, and the judge ordered a Frye hearing.

Although such models have yet to be approved in published New York state decisions, State Farm cited several jurisdictions that have allowed them, including Ohio, Michigan and Georgia.

Mr. Santos relied on the testimony of a fire and arson consultant, Eugene West, who said that computer fire models are not generally accepted by the New York City Fire Department nor by the "fire investigative community."

Justice Phelan agreed with Mr. Santos and barred Dr. Urbas' testimony.

Mark L. Friedman of Wilkofsky, Friedman, Karel & Cummins represented Mr. Santos.

The simulator "piqued my interest because I've been in the field 25 or 30 years and I had never heard of 'computer fire modeling,'" Mr. Friedman said.

He described the Frye hearing as a contest between the "guy in the field" and the "guy in the ivory tower," with the guy in the field winning.

"I thought it was kind of a 'garbage in, garbage out' model," Mr. Friedman said.

Request for SAFER Peer Grant Reviewers

The IAAI is seeking 24 U.S. members in good standing to represent the Association as peer grant reviewers for the Staffing for Adequate Emergency Response (SAFER) Grant at the National Emergency Training Center (NETC) in Emmitsburg, Maryland. The grant review will take place on September 27 - October 1, 2010. Reviewers must be able to travel on the day prior to the evaluation week and the afternoon of the last day.  While you will not be compensated as a reviewer, the Department of Homeland Security will cover travel costs, food and lodging. 

Interested IAAI members should submit the following information ONLY:

1.  Name
2.  IAAI Membership Number
3.  Organization name
4.  Position or title
5.  Mailing address
6.  Daytime telephone number
7.  Evening telephone number
8.  Email address
9.  Have you ever served as a fire grant peer reviewer? Yes or No


Information must be received in the IAAI Office no later than Monday, August 16, 2010 at 17:00 EDT.  Email information to iaai@... with SAFER Peer Review in the subject line.

Qualifications: Current IAAI International members must have experience in career fire department staffing and/or volunteer/combination recruitment and retention programs. Please do not apply if you do not possess these qualifications. 

Qualified applicants will be referred to the Department of Homeland Security who makes the final decision. In the event there are more than 24 applicants, preference will be given to those members who have not served previously as a fire grant peer reviewer. Should there be an excess of 24 qualified applicants, a random drawing will be held.

The IAAI carefully screens all applicants to ensure that those members of our organization we place on panels have the necessary experience to evaluate grant applications in a professional manner.  Once we submit our recommendations, the final decision is the prevue of the Department of Homeland Security.
