By FCC enforcement and the ARRL, following the band plan is 'good operating
practice'....

You can use the gear under part 15 rules that states you can not interfere with
licensed
operators. If it does not interfere under part 15 rules, I see no reason you can
not use it at
those same power levels under part 97 rules....no, it is not following the
letter of part 97 rules,
but I think it follows the intent of cutting interference between modes.

There are a lot of modes that are protected by the band plans that are not
active at all in my
area. Due to terrain, there is no way that other uses here would hurt those in
other areas.
Yet, by the letter of part 97 rules, I should not use other modes in those band
segments.

The band plans need to be updated far more often than they are now to better use
the RF
spectrum we have.
