Kamuda uzun süredir bilinen bazı ürünler başvuru sahibinin beyanına göre, uygulanan incelemesiz tescil sisteminden dolayı yeni ve ayırt edici niteliğe sahip olarak gösterilebilmekte ve tasarım tescil belgesine konu olabilmektedir. Böyle bir tescil belgesi, sahibine tasarımı ticarette tekel olarak kullanma hakkını geçici bir süre sağlarken, gerçekte belge sahibinin itibarının yok olması hatta ticaret alanından silinmesi için atılmış yanlış bir adımdır.

Dear Dilek,
Like a lot of artists who have been around for a while, there
are people out there doing fairly commendable copies of my
work. Some copy "in the manner of"--the general themes and
ideas. Others copy part of the style or as much as they can get
of the style. Some take images from the Internet or other
publications and copy verbatim. Some almost "get it" and apart
from turgid brushwork, the only real difference is the
signature.
Over the past few years there has been a growth industry in
copying the work of the recently deceased French painter
Bernard Cathelin. Perhaps somebody painted like that even
before him. His images and their variations, much in popular
demand for current home decor, have become commonplace under
many signatures. This has occurred because his is pretty basic
stuff and easy to clone--simple flat patterns, minimal drawing,
no light and shade. The work gives few problems to unskilled
painters with an eye for cash flow.
Right now at the Institute of Contemporary Art in Philadelphia,
PA, there's a forty-year retrospective of the work of Richard
Pettibone. He's the guy who makes meticulous, postcard-size
copies of some of the late and recent art icons--Warhol,
Stella, Lichtenstein, Duchamp, Mondrian, etc. The critics of
course love it because they think the work challenges the
popular notions of originality, size, and banality. Think of
it: Warhol's soup cans, which were copied from soup cans, are
copied by Pettibone. Critics also like his fun-poking mix and
match--Dali-ized Warhol Marilyns, etc. Again, Pettibone has
always been careful to copy the stuff he can copy. For the
copyist, Pop is a piece of cake. To my knowledge, he hasn't
made a decent copy of, let's say, a John Singer Sargent
watercolour, because he can't. In this sense, the copyist
Pettibone is being forthright and honest.
The prevalence of cloners may account for why a lot of
brilliant and deft artists are guarded and devious about their
ways and means. Sargent, a private, secretive guy, was known to
labour over work in order to keep it fresh, and to finish with
a flourish to make it look easy. This "speedy" look has defied
his would-be copyists for years. "Mine is the horny hand of
toil," said Sargent. Secretly, I've always felt that Sargent's
attitude was something worth cloning.

maneuvers that might be just a bit tricky to copy. Your "look"
is your look, you own it, and you should know that when it's
appropriated, it has been taken because it's valuable. You have
the goods to change and modify at your pleasure--and to have

Dear Dilek,
Artists of all stripes can learn something from Auguste Rodin.
As in the work of Michelangelo, to whom he was indebted,
Rodin's sculptural material is often cut away only to the
degree that it's creatively needed. This unfinished and rough
aspect is a virtue--the hand of the artisan allows viewer
participation in the art process. Also, simplifying shapes and
means of expression increases an artist's opportunity for
direct emotional impact.
It's this "in one" contrast that makes figures like "The
Thinker" so viable. The athletic physique is transfixed by the
intense capability of the inner man. It's a brilliant example
of body language. In another exemplary piece, "The Kiss," the
female figure is submissive and yet delicately responsive. The
male, in contrast, is powerful yet gentle, his fingertips
resting tentatively on her thigh.
Rodin used caricature and exaggeration to emphasize and bring
life to his ideas. Brutality is depicted with outsize hands,
veins, stressed musculature, distressed sinews. Age is shown
with the weary slump of the material--sag, bloat and
disfigurement. Youth with simplicity and innocence of finish.
Love with palpable eagerness made more so by the absence of
distracting detail.
In the tragic "Burghers of Calais" a state of confusion is
implied by the irregular arrangement of the figures. These are
people in an extreme emotional crisis, their faces perplexed by
immanent doom. Rodin's is an intense personal expression of
elemental power--even the hasty modeling of the clothing seems
to show anguish and stress. Through all this an observant
student should note the very height of the action and the most
telling gestures. It's as if the sculptor took multiple photos
of acting models and selected one as the quintessential. In
order to get an idea of what I'm talking about, I've asked
Andrew to illustrate these ideas at the top of the current

Auguste Rodin (1840-1917) rose from disadvantaged circumstances
and spent his first years designing tiles and masonry. In later
life his sculpture and drawings were in high demand. Much has
been made of the early rejection of his work by the French
Academy and his liaison with Camille Claudel, and others.
Whatever one might think of his life, Rodin was a master. "Work
lovingly done," he said, "is the secret of all order and all
happiness."

Esoterica: Rodin indeed engaged a professional photographer,
Gaudenzio Marconi. As well as photographing finished work,
Marconi took multiple shots of models for Rodin to use at his
leisure. Most notable is the attention to light and shadow,
both soft and hard. Rotated sculpture, like rotated life, when
lit consistently, picks up a moving montage of ever-changing
patterns. Rodin was highly conscious of the "circumambulation
factor." Sculpture, unlike "wall art," was meant to be circled.

Those of you who visit the home page often would have seen it. For those of you who haven't read it yet, here's your chance.
Photoshop World was a blast in Vegas with over 3,000 attending. During the show the nominees were announced for the Photoshop Hall of Fame. To my surprise I was nominated!
I had a blast last week at the ADIM conference in Santa Monica and next week I will be teaching for 12 hours at PIDE in SanDiego.

Whatever you choose to depict, the image must convey the relationship; the attitude and action; and the emotions of the Master and Servant archetypes.

Welcome to the March issue of the CAFÉ cup!
Welcome to the CAFE cup for March.
Next week sees the kick-off of Photoshop World in Mandalay Bay, Las Vegas. I will be heading out on Monday and will have the PhotoshopCAFE booth on Tuesday and Wed. I hope you can come by and say hello. The online store will also be open and orders will be shipped during this time. I'll post a report at photoshopCAFE while the festivities are in full swing.
This year has started out very strong for the web and we will focus on web in this issue of the "cup". I have authored the Photoshop and Dreamweaver Integration book, the Photoshop and Dreamweaver Integration DVD and Co-authored a book in Hall of Famer Jack Davis series, How To Wow - Photoshop for the Web. (Read about all these resources in this issue)

Coffee With Colin :: Ma'am could you please restrain your webpage?
I remember the early days of web design when the world united in an uprising against the villainous Blinking text. This was so successful that the <blink> tag was actually removed from HTML. I am totally serious about this. This weapon has been removed from the hands of the dangerous, however there are other annoying things within reach of children.
The successor of blinking text is the animated gif. This harmless looking character can become a menace in the hands of the "ohh this is so cool" crowd. Imagine reading a book that is crawling with ants and little characters hitting the pages with hammers, perhaps dinosaurs running across the pages only to disappear in a puff of smoke? And just when you get to the final part of the story, a Vegas style marquee jumps up and shouts "Hit the monkey to win!" Would you read this book? Then why do we do this to our web pages?
I think part of it is the misconception of more is more. Or as they said on Deep Purple's classic "Made In Japan," can we have everything louder than everything else." If you really want to get attention on your web page, a yelling carnival of activity will not achieve this. More than likely the viewer will scream and then breath a deep sign of relief as they click away for the site as fast as possible.
When you design your web page, think about content first. (The actual meat of the site) Then think about navigation (The way to get to the content). Animation, imagery and color are there to enhance and augment the content, not to replace it. Animations are not wrong in themselves, however try to slow them down a little and avoid fast jerky movements or sudden flashes. Please. I want to read your page and enjoy your wonderful content, not use your site as a tool to trigger a seizure.
Web tip: Make sure that you use descriptive titles in your page titles. These are one of your main tools for getting a good page ranking in search engines. "Untitled doc" won't get you much traffic.

Artist Profile - Eric Hanson
We interview Eric Hanson, renowned VFX artist who worked on The Fifth Element and The Day After Tomorrow. Eric Hanson is a visual effects designer who specializes in digital sets and backgrounds for feature film projects. He is currently overseeing production of visual effects educational DVD titles at The Gnomon Workshop, as well as teaching there and at the USC film school.

Artist Profile - Stephan Martiniere
Stephan Martiniere is an internationally renowned science fiction and fantasy artist. He is the recipient of numerous awards including silver and a gold “Spectrum” Award, two Master awards and an Excellence “Expose” Award. In his varied career, Martiniere has worked in animation, video games, theme parks and book covers. He is also an accomplished concept artist who has worked on movies such as ‘I Robot', ‘Star Wars' (episodes Two & Three), ‘Virus', ‘Red Planet', ‘Sphere', and ‘The Time Machine'.
Stephan Martiniere is currently the visual design director for Midway games in Chicago. Midway is the company primarily responsible for games like Mortal Kombat. Stephan describes this as an unexpected situation that turned out to be the right one at the time. “I spoke with my wife about the possibility of working for another company', explains Stephan. “We made a decision that it had to be the right job in the right location. Midway came totally out of nowhere, I wasn't considering Chicago and it turns out to be a fabulous city."

This illustration was done for Paizo Publishing's Dragon magazine. The Art Director, Sean Glenn has always given me a lot of freedom with my ideas, and gives the kind of feedback that only enhances the painting and the process. The initial direction given was for a group of heroes to be in the middle of a dungeon, about to be swarmed by a horde of goblins. The attention should be primarily on the heroes, and then the goblins.

I'm a big fan of comic book illustrations and always wanted to make a 3D version of my favorite characters. After seeing the Batman image that a friend, Ricardo "Zy" Thiele did, I had the idea to make a 3D version of The Joker, one of my favorite villains. The main task I had in mind was to capture in one image the very sinister and sarcastic atmosphere. To get this effect I would need a good light and a good facial expression to show his wild personality.

Machineflesh Book Announced!
Today we're very proud to announce the first in the series of CG Challenge books documenting the contests. Machineflesh is a high quality publication by Ballistic Publishing, celebrating the artists who entered the Machineflesh Challenge. The book is a healthy 50% split of tutorial 'making of' content from the winners and a gallery of images entered for the Challenge. It is important to note that these Challenge books will fund the CG Challenges, keeping them free to enter for everyone!
Production of the Grand Space Opera book will begin at the conclusion of judging - all artists have been notified by email.
Grand Space Opera Public Voting Opens! This has been the best CG Challenge to date! The Grand Space Opera Challenge closed with over double the number of completed entries than the previous Challenge, many of which were of stunning quality. The feedback from artists on the Challenge has been excellent, many of whom learned and improved their skills immensely through its course.
Public voting for the Grand Space Opera Challenge is now online and will close on 27 January 2005. After that, a celebrated team of judges will vote on the winning entries. Winners will be announced on 14 February 2005.
We hope that you'll be able to enter our next CG Challenge in March 2005! More details will be announced soon, so stay tuned!

Fallen Art - Interview with Tomek Baginski
Fallen Art is the all new short film by Oscar nominated Tomek Baginski. We recently interviewed Tomek, who shared the challenges faced while making the short film, along with an exclusive behind-the-scenes look at the film.
The biggest challenge during the production was time. While there was a tight deadline, there was an even tighter budget. “There were days and weeks, especially at the beginning when I was the only person working on the film. It was rather like a long race”, says Baginski. “I wasn't sure we would make the deadline until the last three weeks. The people who participated in the project did a great job. Most of them did it in their free time which is much more important. The project could have fallen over dozens of times.
