Yes, it is creepy!  I think you've done all you can do by removing her photos and confronting the "perv" about their account.  Keep an eye out for any new photo postings, and if you find any, remind the "perv" that it's not too difficult for the authorities to find out who's posting them!   You have to protect your family as best you can, it's a weird world we've ended up with.  I'm almost 65 years old and have seen a lot, but not as many sickos as there seem to be today!
 
A little FYI...if you post photos on Flickr, you can make them private and that way only family and friends can view them....you might want to consider that option to be able to share your personal photos.

That would creep me out! Maybe Erica has an idea, but I would change my profile and pics from "public" to friends and contacts only, and Block that person since they have made you a contact. You will have to change some of your contacts from "contact" to "friends & family"

I've just had a rather lengthy email exchange with an individual that I photographed yesterday.  His aunt paid for the photo shoot and my contract was with her. He originally asked me for my unedited images, which I politely declined and offered to sell him a CD of the edited .jpg images for $5.  (Yeah, most pros charge I think $100 these days.  Good deal, no?)  In the end (I'm sparing you a lot of back and forth) he sent me a copy of my screen-grabbed watermarked image and his edits (which you can see for yourself here: http://www.flickr.com/photos/jessiewhittle/4127010434/ - a little harsh perhaps but I'm mad), and said "And, there are multiple ways to take an image off of a site, rather than right clicking.You should look into my agency's design portfolio if you'd like us to revamp your site so you can be sure no one can get the images, if you're that serious about keeping them."  His email siggy indicates he works for a visual arts firm of some sort.

I advised him that what he had done was illegal, and he countered with "Creative Copyright Laws also allow me to edit images legally obtained, and since I'm not using them to make money (I'm using them for a photo album) I don't think there are really any legal implications. Especially since I'm not claiming the images as my own." 

I'm so mad I'm shaking, and I can't properly research the matter.  Can anyone point me to something that indicates whether this is true or not?

I've also got a phone call in to his aunt...  and her gallery has been locked down and she won't be receiving her CD's until the little matter is cleared up...

I'm not sure where you are located, but there is no such
thing as "Creative Copyright Laws" in the US.  Making
money has nothing to do with it either.  The fact is
that the copyright holder owns *distribution* rights.
Technically, if you mark your images as licensed for
viewing only, that would mean making a print would be an
illegal distribution, for example.

However, given that he isn't selling or otherwise
actually doing anything to damage you, that angle might
be an expensive waste of time to follow.

On the other hand, he has literally committed a (minor)
crime, threatened to repeat it, and attempts to coerce
you into a business contract with his employer.  I would
suggest that his employer might find that less than
amusing!  To really have an effect, spend a 2-3 hundred
bucks or whatever it costs, and have an attorney write
up a letter informing the employer of the above
transaction.  Don't get mad, get even!

You have to report her to Flickr, she can not use your pic as her profile
pic. I also noticed the other guy, warzin, also has a daughter named
MacKenzie. I guess she likes the name. But it sure is creepy.

Did you ask what blog it was?  Many people who have blogs find photos for them on Flickr.  I'd think that if they were going to do something really horrible with it, they never would have asked you first.  I think I would have asked a few questions before getting that freaked out.  ...it's good to be suspicious, but if you jumped all over the person for just asking, I think you went a bit far.

I re-read your message after finding your 2nd and the link and I agree that the name of the person justifies some of the freak-out, but it's still really odd that they contacted you.

Have you mentioned your location on Flickr?  Have you geo-tagged any of the photos of your daughter?  (As a side-note I just want to mention that I don't think this is a general problem and I don't think putting photos of children on the internet makes them significantly more at risk than those who don't have photos online.)

If your location is likely known, it's important to know that most pedophiles live near and know their victims.  If that's what you're suspecting, you're WAY more likely to find the person who's targeting your daughter is your babysitter or a family friend than a creepy guy on the playground.  Most people don't know that, so just make sure you look in both places (known and unknown) for potential suspects.

Another thing to do if they know your location is to try going to your local police station and making a report.  I had to do this for someone who was stalking me in high school/college and they were VERY hesitant to even make a report muchless do anything about it because a crime had not yet been committed, but having a record of events at your local PD may be helpful down the road if the person becomes known (and like I said, they'd most likely be local).  ...if you can find someone helpful, they may have a cyber-crime person you can talk to about what to watch out for, etc.

But try to keep your wits about you.  The fact that they contacted you about using the photo still strikes me as odd and the name of their account is just a duplicate of your sig, so I still think there's room for this to be innocent, but I agree that it's strange.

Thanks.  I had considered notifying the employer, but their website says they've "grown" to a whopping five people in the business.  Something tells me they're a tight-knit bunch of friends and I'd be wasting my time and effort.  I finally got in touch with his aunt last night, who was my actual client, and told her what had happened.  She asked for a copy of the emails and said she's "going to let his dad take care of it."  From the tone of her voice, that might just be sufficient.  ;)  I can only hope.  His aunt works with my husband and she was mortified at what he'd done, and very apologetic. 

I knew all along this was a possibility, just never expected it to be thrown in my face like it was.

I did not put that sig on the photo they did. They downloaded the pic and put it
on there. They got her name from a collage that I made and called the many faces
of Mackenzie Rae. The person writes in broken english and I think that it is  a
woman her name is Bruna. I have geo-tagged her pics. I am a stay at home mom so
the only baby sitter she has had was her half-sister and that was once. I just
don't understand why someone would open an account like this. I can't figure out
how to contact flickr. The only thing I can find is report abuse and they don't
let you explain what is going on.

Here's the link to what you need to do to report the copyright violation.  http://info.yahoo.com/copyright/us/details.html  You have to be VERY SPECIFIC in your wording, as I got one little part wrong (thought it was obvious) and they kicked it back, taking even longer than it should have to have my photo removed from the bad guy's stream. 

I really can't get over the feeling that this might be someone you know who is watching your reaction.  I mean... why else contact you at all and alert you to the flickr account?  There's just something about that that's bizarre.  I have a BA in Criminal Justice, and my husband and I both work in the field (me at the courthouse and him at the sheriff's office) and something just doesn't feel right about this to me when I take into account everything I've studied.  Erica was right... you need to look at those you know.

And let me repeat:  take your correspondence, screen shots of the Flickr account, your stolen photo, etc and visit your local police dept.  Just ask them to make a report so there's a history of the issue.  Make a copy for them to keep on file -make it as easy as possible for them to go ahead and document the issue.

I just googled MacKenzie Rae - there are literally dozens of people with that name that came up on Google, most having a blog. MacKenzie Rae is also an artist (singer). I am not at all trying to downplay your concerns over this but I have to wonder if this is a kid messing around on Flickr. That said, you are right to be concerned and certainly to report them to Flickr for using your images.

I was trying to downplay the camera body itself.  This shot could be taken with
any SLR and didn't need the "L" glass for Canon or the equivalent for Nikon. 
Yes, I was using a $2600 Canon EOS 5D MkII, but, a $600 Rebel could take the
shot just as well as long as the photographer realizes it doesn't take the high
end equipment.  That was my point.  I would be happy to go back with my 30D and
try it again if I lived close enough and the bird would cooperate again.

A simple B&W study of lines.  The subject doesn't actually have any straight
lines, but perspective is a usefull tool.

Thank you to everyone who helped me with the account made of my daughter. I did
take a screen shot and took it to my local police. Just in case. I reported it
to flickr and also sent a note to her other contacts warning them. I had blocked
her. Flickr was on top of it and her account is now closed. *sigh of relief*
Strike one up to lesson learned.
Again thank you to all who helped me with my dilemma.

Thanks Klaus!  Yes, that is my photostream.  A generally random mix of
stuff.from landscape to abstract, and even some abstract landscape...

I have a page on my website of "Potential Keepers". I'm unsure if they are good
enough to go in my other galleries. I've gotten some notes on keepers from
people I know, but would like to know what other shooters think.

The page can't be navigated from my site, but here's the link:

There are 46 thumbnails surrounding the main image area. When you mouse-over the
thumbnails, the main image changes along with a text field below the words
Potential Keepers. The text field has the name of the pic along with the
potential gallery it would go in: Nature, Landscape, Cityscape or Abstract.
Also, there is a tip that pops up of the file name when you are over the
thumbnail.

The 46 thumbnails are a little tight to navigate around but doable.

Basically, I need some unbiased opinions of Yea or Nay, Thumbs-up or
Thumbs-down, worthy or unworthy - you get the idea. I could really use the help
being that I'm no longer objective when it comes to these pics. I know it's a
lot to review, but if you could spare 5-10 minutes and email me the names of
images you really like, that would be fantastic. I'm not sure if we would want
to reply here, but if that's okay then do that. Otherwise, write down the names
you like, email me from the Contact page or directly at jimkernicky@....
If there's anything I could do in return, let me know – especially if it's help
in building a website.

I also have 40 pet portraits on another site, which I'd like to narrow down to 2
pages of the top 20, but I'll post another thread after this one runs its
course.
