Carl,

I asked a similar question a couple of weeks ago. Pat from Pat's
Podcast responded with:

You might wanna check out this website -
http://www.mr-seo.com/wordpress/?p=45

That'll get your feed out there. The other thing to do is to do a
promo for your show, and there are a few sites that cater to
cross-promotion of podcasts. (If you want to do that with me, let me
know - same goes with anyone else out there!)

Well, what's worked for me, so far, up to a point, is just a little sig on
my emails and newsgroup postings. Awareness is the first step. Try to
post intelligent content in related email or news groups with the sig, and
at least you'll get curiosity going -- there are lots of podcasts, but it
seems like most people don't know what they are.

I also listen to a fairly large number of other podcasts, and I voice-
comment on those when I have something worthwhile to say, and always
identify myself as "Grizzly from the Grizzly's Growls podcast." Note the
something worthwhile to say, though; nobody wants an extra commercial in
the middle of a show they love. I'd imagine radio shows would be a good
outlet there, too. Any good \

There are other good options, and I'm sure there'll be plenty of good
posts on those, too. I don't follow that topic, but are there good
betting and horseracing radio shows out there, that take listener calls?

Good luck with your show.

I've considered the Promo thing, but I have no idea what I'd say on a
promo -- most of the time I have no idea what I'm going to say on the
show! <grin> Sounds like it ought to be a good idea, though.

Hi

We are happy to release the June 07 issue of Corporate ezine PR-e-Sense with
the theme "Corporate Podcast"

Corporate Podcasts are emerging as exciting and revolutionary alternate
medium and sweep across the globe. Many of the Corporates in US, UK and
other European countries have started using podcasts for promoting their
brand image and positioning their pdocuts and services.

In the developing countries like India, there is lack of awareness amongst
the corporates on this new medium. Corporates need to relook into their
strategies and effectively use 'Corporate Podcasts' for their clients.
Corporate Podcasts will function as 'formidable ally' to the other channels.

In the June 2007 issue of PR-e-Sense Mr Sunil Nair (CEO, Nautanki
TV<http://www.nautanki.tv/>),
Mr Syed Nazir Razik <http://orione.wordpress.com/> (Technocrat) and Ms
Chinmayee <http://chinmayisripada.blogspot.com/> (a well known Radio and
Television Jockey and film playback singer) have given their views on
Podcasts. This ezine is also integrated with a podcast in audio form. We
have incorporated a sample marketing podcast in our audio podcast.

Hey Guys,

I just wanted to see if I'm alone here. For the past week or so I've been unable
to upload
any of my files to Libsyn using ftp via Transmit, which is what I've used since
starting the
podcast. I keep getting the error message: "Could not connect to server
"ftp.libsyn.org"
Server said: Login incorrect," despite the fact that I know the login details
are correct. I
also tried the "ftp.libsyn.com" with the same result.

I've been able to upload by logging directly in to Libsyn site - proving my
login details are
fine - and doing it that way which frankly is a pain. I email tech support over
a week ago
but haven't heard a peep back from the Libsyn team, which is unfortunately
becoming a
bit of a trend!

Is it just me or has anyone else had this problem / been able to resolve it?

Cheers

Well, I didn't have a problem FTPing my file last weekend, but haven't
done one since then. See if you can set a longer timeout in your FTP
client; I know with many Internet clients, "bad login" is the default
error message when the client doesn't know what happened.

The issue here is there are a handful of shows that play RIAA controlled
music, the very high majority play music that will not get the sued by the
RIAA and if a podcaster today. There is only one of those license
organizations that even remotely have any language in their licensing
provisions that protect a podcaster. The very simple fact is this if you
play RIAA controlled music in your podcast and make that file available for
"download" it is not at all podsafe and the podcaster can have his butt
hauled into court just as fast a person sharing file in peer to peer.

Podcasting has it tenants in podcasters playing podsafe music you can try
and get a license from all of these organizations but guess what unless your
are streaming your podcast versus allowing it to be downloaded there is no
safety net. To think otherwise is being very ignorant. This has been looked
at by a variety of lawyers that are well respected in the podcasting
community. Podcasters have already been issued cease and desist in the past.

But to this date I have heard of no tenants or amendments to at least two of
these organizations licenses that allow one to play music under the control
of the RIAA and make it available for download. Until the time that
podcasters can legally be 100% protected under the law in playing RIAA
controlled music there will be no category on the Podcast Awards site that
recognizes shows that are technically breaking the law.

That being said I think it sucks that there is no way for a podcaster to be
able to 100% protect themselves in playing RIAA controlled music. The big
hangup remains that the media is a physical download which could allow a
person to be able to get the track for free and not have to pay the artist
for the music.

Are you saying that the They Might Be Giants podcast is in danger from

I'm not sure what you're asking for.

Usually a podcast "badge" is something you use on your website to put
in a direct link to your feed in a way that is understandable to a
particular podcatcher. The graphic that you want for iTunes is more
like cover art, isn't it?

They could get a C&D from the record company they were on previously
if they don't actualy own the rights to their music - which a lot of
bands do not because they got crappy contracts when they were first
starting out. Noticed that even though TMBG has a podcast - they only
have one song on the PMN?

I understood this as you are looking for someone to help wtih a graphic for
your podcast? There are several creative foks out here to build logos,
etc. May help to explain more about your show and what you have in mind.

There are licensed RIAA-compliant music podcasts as well. Exempting them
because the RIAA can come after unlicensed ones seems odd.

Yes, I meant a piece of artwork, a small graphic or illustration that
will pop up in the podcast directories next to the description of the
podcast.

The podcast I want to do is an interview format in Spanish. I have an
idea in mind for the artwork but don't have any artistic talent.
That's why I was posting.

Anyone who does illustrating/graphic design for a living?

Who are these licenses RIAA compliant music podcast and how did they exactly
get that license it is a question a great many podcaster has been asking for
a very long time. Unless something has changed then to my knowledge there
are no provisions within at least two of the licensing organizations for
podcasters that play RIAA controlled music that involves a "download". To my
knowledge offering RIAA controlled music for download via podcast is not
covered. If the podcaster gets written permission from a band to play a
track then that's a different story. But most artist have signed contracts
that specifically prohibit them from signing such a document.

While I am not an expert in this I think the think that the ambiguities has
made most podcasters not even try. With the exception of ASCAP, BMI and
SEASAC have no specific license provisions for people providing music
available via download. Plus with the new copyright board pricing for
streaming music going into effect July 15th and retroactive to the beginning
of the year then if podcasters are following streaming play and pay rules
then they are in for a big sticker shock.

Todd -

You quoted what he said but missed its understanding.

Coverville plays covers, not originals, and there's a difference. If I wanted
to play Led Zepplin's Stairway To Heaven then I would be violating the holder
of those mechanical rights, which is almost certainly the Harry Fox
organization (the last time I spoke with them I was told that they were in the
process of putting together a licensing scheme, but I'll believe it when I see
it).

OTOH, if I recorded myself playing Stairway To Heaven and played it on a
podcast then I would not be violating the rights of the mechanical rights
holder, I would be violating the rights of the performance rights holder, which
would almost certainly be ASCAP, BMI or SESAC.

These organizations do have licensing schemes. Coverville is paying these
licensing fees and is not doing anything illegal, which is the root of the
complaint. Although I am a huge proponent of podsafe music, I do understand
his point that despite the fact that he is doing everything right, he is
excluded from the category.
