i finally got it fixed. i had searched the net for anyone posting
similar issues ( and there were a lot ) but my situation was unique...
for them there were a page or 2 of nothing between their main stuff
( email, safari, settings etc ) on the first page and then all their
apps were several pages later. on mine that was not the case mine
were actually GONE from the ipod. and also something that seemed
unique to me was all my video was gone ( my photos and music were
untouched ) i couldn't find any reports of video having disapeared.

i was able to load video back on during sync... i tried several more
times to sync my apps ( i had some deselected ) nothing, then on a
whim i tried letting it load ALL my apps not just the ones i wanted on
there and then it worked ( and it did then put a blank page or 2
between ALL my apps, including all the ones i didn't want on it, and
the front page of apps. ) so then i spent a tedious amount of time
deleting ones i didn't want and then moving all the others over into
the blank pages and reorganizing them all

major pain, not sure why we were expected to pay for such a hassle. i
hope the upgrade is worth it. right now i'm a bit to tired of my ipod
to play with it for a day or so.
