JCT: Last May 6 2003, the day of the Supreme Court of Canada
hearing of the Clay-Caine-Malmo-Levine cases in Ottawa,
the police raided the Section 56 Compassion Club located
at 136 Sears St. in Toronto. Sick guys Bruce Ryan, Pierre
Champagne and James Wallace were charged with production of
marijuana, possession (over), possession (under), possession of
hash, possession hash for the purpose of trafficking, and, the
precedent for my own upcoming motion in Ottawa next Thursday
June 17 is their possession for the purpose of trafficking charge.

Pierre wrote a letter explaining his situation:

Dear Mr. Layton.

My name is Pierre Champagne and I reside in your constituency
near Queen and Pape Avenue. I'm writing to inform you of an
ongoing situation involving "SECTION 56", a compassion club
at 136 Sears Street. (Queen Street and Greenwood area)

Please allow me clarify "compassion club" for you. I am HIV
positive and have been prescribed Cannabis by my doctor as
an adjunct to my chemotherapy. I used to work as a manager
at SECTION 56 up until October, 2003. We provided organically
grown, quality marijuana to sick and dying people, like myself,
who also had physisian's statements registered with us. The
operation provided a safe and pleasant environment, and
helped many people who all vote, and through our group is
looking for the right candidate!

Unfortunately we can no longer operate in a safe way.
We've been closed down due to raids and harrassment
from 55 Division undercover drug officers who know what
we are doing is legal. A fair number of our membership also
have Health Canada (legal) exemption cards, to possess
and use marijuana. All their private records have been
seized and kept.

May 6, 2003, we were raided the first time. Four people were
detained. One was let go, but three were held for two days
and charged. We continued to operate the club while
fighting the charges in court. Two of the accused have
since been set free.

September 30 2003 I, personally was arrested at 136 Sears
Street, with NO warrant, by D.C. Robert Warrener. (55
Division) I state that they then used my club keys to
enter the premises to collect their "evidence" before
getting a summons to search warrant. I won't go into the
details of my personal ordeal now, but I was led to
believe that I would be spending the night in that cold
cell. (I'm prone to pneumonia) Also, I was being denied
my HIV meds, as well as food and drink for eight hours
of my stay.

October 30 2003, I was further harrassed by my arresting
officer as I was leaving my doctor's office on Queen
Street near Jones. My doctor's visit was to get help for
the anxiety and stress I had been experiencing. My name
was called out from a police car behind me parked on the
street. I thought, possibly it was for a basic
Identification and complied. I felt I was kept there for
about five minutes, without any real questioning.

November 27 2003, my friend, Bruce Ryan, was arrested
at Police Services Headquarters, 40 College Street. He
was trying to obtain his police report to send to Health
Canada, to whom he was applying for a licence.

October 17 2003, awarrant had been issued for his arrest.
Please feel free to call him at 416-833-9664, as he is much
more articulate than I on this history of harrassement.

Three of us have been defending ourselves through the
court system for over a year now. 55 Division has
ignored our requests for Full Disclosure with delay
tactics and not responding, all along.

May 5th 2004, I received a letter from Julian Fantino's
office denying my personal request for disclosure,
because some of the very same officers are currently
being investigated. In this letter he quotes from the
"Municipal Freedom of Information and Protection
of Privacy Act". (Copies attatched)
Highly ironic since my privacy, and that of others,
has been violated. Plus, there's been very little Free
access to Information for our side.

May 13 2004, at our most recent appearance at Old
City Hall Courts we filed, on our own behalf, a
motion to have all charges be dismissed. June 9 2004,
this motion will be heard, at the same location, in
Courtroom # 102, at 10:00am

Is there something you can do to help us? is my
umble request. I voted NDP the last election, and
have found myself in allignment with NDP policies
for a long time. Our group can carry many
thousands of votes for the Right Party!

JCT: So that's their problem. These fatal-disease guys
were hit with every charge in the book. What's important
to me is that my Parliament Hill Bust is facing the same
charge: possession for the purpose of trafficking next
Thursday June 17 in Ottawa.

But for today's medpot adventure before Sheppard, , I found
it curious that the Crown had no paperwork so I
assumed they were going to ask for an adjournment. I even
asked the Crown, Jeffrey Roi, if they were going to file a
Motion Record. He just said he'd speak to the court.

Once Judge Sheppard opened the court, the Crown rose and
announced that "The Ministry of Justice has reviewed these
cases and has decided that it is no longer in the public
interest to continue with the prosecutions. The charges are
withdrawn.

That's the first use of the Krieger card for defeating the
cultivation charge and it sure is going to help me out in
my case next week for the healthy guys defeating
possession for the purpose of the Biblical
7-pound 7-year supply.
